Program Description

These Terms and Conditions (“Terms”) govern your access to and use of FireGator LLC’s (“FireGator,” “we,” “our,” or “us”) products, services, and the FireGator NightWatch vehicle fire detection and monitoring platform, including any SMS alert programs operated in connection with those services.

By purchasing FireGator equipment, enrolling in the NightWatch monitoring service, or receiving SMS alerts from FireGator, you agree to be bound by these Terms. If you do not agree, do not use our products or services.

NightWatch SMS Alert Program

FireGator NightWatch is an automated vehicle fire detection and monitoring service that delivers real-time SMS safety alerts to enrolled fleet operators, transportation directors, and designated contacts when sensor anomalies are detected.

Consent to receive SMS alerts is obtained through a written service agreement signed during FireGator NightWatch system installation and onboarding. By signing that agreement, you authorize FireGator to send automated text messages to the phone number(s) you provide for the purpose of fire detection and safety notifications.

To opt out of all SMS communications, reply STOP to any FireGator message. You will receive one final confirmation message and no further alerts will be sent. To re-enroll, contact us at the information below.

Eligibility & Enrollment

FireGator products and services are intended for commercial and institutional customers, including fleet operators, school districts, transit agencies, and golf course operators. You must be at least 18 years of age and authorized to enter into a binding agreement on behalf of your organization to enroll in any FireGator service.

Enrollment in NightWatch SMS alerts requires a valid US mobile phone number capable of receiving SMS messages. FireGator does not currently support international SMS delivery.

Use of Services

You agree to use FireGator’s services only for their intended purpose: monitoring vehicles equipped with FireGator hardware for fire and heat anomalies. You agree not to:

• Tamper with, reverse-engineer, or modify FireGator hardware or software
• Use the NightWatch platform or SMS alerts for any unlawful purpose
• Attempt to gain unauthorized access to FireGator’s systems or data
• Provide false or misleading information during enrollment or onboarding
• Resell or redistribute access to the NightWatch platform without written authorization from FireGator

FireGator reserves the right to suspend or terminate access to the NightWatch platform for any user who violates these Terms.

Hardware & Equipment

FireGator suppression and detection hardware is sold under a separate purchase agreement. Title to hardware transfers to the customer upon full payment. FireGator provides a limited warranty against manufacturing defects as described in your purchase agreement.

Installation of FireGator equipment must be performed by an authorized installer. Unauthorized modifications to hardware, including changes to wiring, sensor configurations, or firmware, void the product warranty and may create safety hazards. FireGator is not liable for damage, injury, or loss resulting from unauthorized modifications.

Disclaimer of Warranties

FireGator’s NightWatch monitoring platform and SMS alert service are provided as supplemental safety tools. They are not a substitute for proper vehicle maintenance, fire suppression system inspection, or emergency response procedures.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIREGATOR PROVIDES ITS SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED SERVICE.

FireGator does not warrant that SMS alerts will be delivered without delay, that the NightWatch platform will be free of errors or interruptions, or that the system will detect every fire event. Cellular network availability, carrier delivery windows, and device connectivity may affect alert delivery.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIREGATOR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE NIGHTWATCH PLATFORM, SMS ALERT SERVICE, OR FIREGATOR HARDWARE, EVEN IF FIREGATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall FireGator’s total liability to you for any claim arising out of or related to these Terms or the services exceed the total amount paid by you to FireGator in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless FireGator LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the NightWatch platform or SMS alerts; (b) your violation of these Terms; or (c) your violation of any third-party right.

Termination

Either party may terminate the NightWatch monitoring service with 30 days written notice. FireGator may terminate or suspend service immediately if you breach these Terms, fail to maintain payment on monitoring service fees, or if continued service creates a legal or safety risk.

Upon termination, your access to the NightWatch platform will be deactivated and SMS alerts will cease. Hardware remains your property. Data associated with your account will be retained in accordance with our Privacy Policy.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in South Carolina.

Changes to These Terms

FireGator reserves the right to update these Terms at any time. We will notify enrolled customers of material changes via the contact information on file or through notice on our website. The “Last Updated” date at the top of this page reflects the most recent revision.

Your continued use of FireGator services after any update constitutes your acceptance of the revised Terms.
